Collateral source bills in both House and Senate receive initial approval

HB 95, sponsored by Representative Joe Don McGaugh and supported by Associated Industries of Missouri, was approved by the Missouri House today. The bill modifies provisions relating to the collateral source rule and provides that parties may introduce evidence of the actual cost, rather than the value, of the medical care rendered.

In addition, the Senate’s version of the collateral source bill (SB 31 sponsored by Senator Ed Emery) cleared the Senate after several days of debate.

The Senate bill now moves to the House and the House bill now moves to the Senate for further consideration. The same legislation was vetoed by former Governor Jay Nixon last year, but is expected to receive more favorable consideration by Governor Eric Greitens.
